PROTECTION OF PERSONAL DATA AND PROCESSING POLICY

Lani İstanbul Tekstil Sanayi ve Dış Ticaret A.Ş. (Lani İstanbul) respects your privacy and have a high opinion of your data security. This text has been prepared in order to inform and enlighten, in this context within the scope of the Turkish Law on Protection of Personal Data No. 6698 (“DPL”) and other relevant legislations.

Informing

Protection of Personal Data No. 6698 was passed on March 24, 2016 and came into force upon publicly on Official Gazette of the Republic of Türkiye (Turkish: T.C. Resmî Gazete). According to Article 32 of the law titled, articles 8, 9, 11, 13, 14, 15, 16, 17 and 18 of this Law came into force as of October 7, 2016.

This Law is to protect fundamental rights and freedoms of persons, particularly the right to privacy, with respect to processing of personal data and to set forth obligations, principles and procedures which shall be binding upon natural or legal persons who process personal data. With this text, visitors are informed and enlightened by “Lani Istanbul”, and the “Protection of Personal Data and Personal Data Sharing Permission” is presented to the visitors for their information and review.

Lani Istanbul accepts, declares and undertakes that not to sell, rent or in any way use to third parties your name, e-mail address, work and home address, telephone number and other personal data provided by visitors through the forms on this site.

Processing of Personal Data

Processing of Personal Data means that performing on your personal data, such as obtaining, recording, storing, preserving, changing, reorganizing, disclosing, transferring, taking over, making available, classifying or preventing its use, in whole or in part, by automatic means or non-automatic means provided that it is part of any data recording system.

Data Controller and Contacts

According to the law; your personal data may be processed the scope of explained in this text by Lani Istanbul as responsible of the data. Lani Istanbul is who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data filing system. When Data Controllers’ Registry is accessed, data controller is going to be registered, and it is declared the registered data controller will be posses the status of being a registered data controller.

Why We Process Your Data

Your personal data is processed in accordance with Articles 5 and 6 of the Law, including but not limited to these, for implementing the necessary operational activities in the company to ensure  that the products and services offered by our company can be provided, carrying out the necessary studies with the relevant business unit and business partners in order to offer you, our customers, products and services that are suitable for your consumption and purchasing motivation, ensuring the rights of real persons by providing human resources management by our company, applying the necessary steps regarding the making, implementation and execution of commercial decisions by our company, and to ensure the legal security of the real persons with whom we have established business relations and our Company arising from these relations, and for similar purposes

Personal data may be processed by Lani Istanbul as a data controller, without seeking the explicit consent of the data subject only in cases where one of the following conditions is met:

 a) It is expressly provided for by the laws.

b) It is necessary for the protection of life or physical integrity of the person himself/herself or of any other person, who is unable to explain his/her consent due to the physical disability or whose consent is not deemed legally valid.

c) Processing of personal data of the parties of a contract is necessary, provided that it is directly related to the establishment or performance of the contract.

ç) It is necessary for compliance with a legal obligation to which the data controller is subject.

d) Personal data have been made public by the data subject himself/herself.

e) Data processing is necessary for the establishment, exercise or protection of any right.

f) Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.

Your Personal Data may process as following purporses;

  • Communicating with you and others as part of the task.

  • Sending you important information about changes to our terms of service, changes to our electronic services, and other administrative informations.

  • Providing quality, training and security improvement (for instance, regarding recorded or monitored phone calls to our contact numbers)

  • Resolve complaints and process data access or correction requests.

  • Prevent, detect and investigate crime, including fraud and money laundering, and analyse and manage other business risks.

  • Complying with legal obligations, including anti-money laundering and counter-terrorism laws, and responding to requests from government and state authorities (including those outside your country of residence),

  • Managing our infrastructure and commercial operations, including audit, finance, and accounting; billing and collections; information systems; data and website hosting; business continuity, records, document, and print management, in accordance with internal policies and procedures,

  • Determining and defending legal rights; protecting our activities or the activities of our business partners, our rights, our privacy, our security, our property and/or those of others; applying available remedies or limiting our damage,

  • Conducting market research and analysis, including satisfaction surveys,

  • Facilitating your participation in campaigns and similar promotions and managing these activities,

  • Facilitating the social media sharing function,

  • Personalizing your experience with electronic services by presenting you with personalized information and advertisements related to electronic services. In this context, personal data may be shared with our business partners, suppliers, shareholders, legally authorized public institutions, and private individuals in accordance with the personal data processing conditions and purposes specified in Articles 8 and 9 of the Personal Data Protection Law (KVKK). Method of Collecting Personal Data and Legal Basis, Your personal data is collected by our company through various channels and based on different legal grounds to carry out our commercial activities. Personal data collected for this legal basis may also be processed and transferred for the purposes specified in clauses (b) and (c) of this document, within the framework of the personal data processing conditions and purposes outlined in Articles 5 and 6 of the Personal Data Protection Law (KVKK).

Rights of the Data Subject Under Article 11 of the Personal Data Protection Law

As personal data owners, if you submit your requests regarding your rights to our Company using the methods set out below in this Information Text, our Company will finalize the request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if a fee is foreseen by the Personal Data Protection Board, the fee in the tariff determined by our Company will be charged. In this context, personal data owners;

  • Find out if your personal data is being processed,

  • Request information if your personal data has been processed,

  • Learn the purpose of processing your personal data and whether it is used for its purpose,

  • Learn the third parties in your country or abroad to whom your personal data has been transferred, request the correction or delete of your personal data if it is incomplete or incorrect,

  • Even if personal data has been processed in accordance with the KVK Law and other relevant legal provisions, the right to request the deletion or destruction of personal data if the reasons for its processing no longer exist, and to request that the action taken in this regard be notified to third parties to whom the personal data has been transferred.

  • Object to the occurrence of a result against you by analyzing your processed data exclusively through automated systems,

  • You have the right to request compensation for any damage caused by the unlawful processing of personal data. According to Article 13, Paragraph 1 of the Personal Data Protection Law (KVKK), you can submit your request to exercise the rights mentioned above to our company either in writing or through other methods determined by the Personal Data Protection Authority. Since the Personal Data Protection Authority has not yet defined any methods, you are required to submit your application in writing to our company in accordance with the Personal Data Protection Law. In this text, the channels and methods through which you will submit your written application to our company under Article 11 of the Personal Data Protection Law (KVKK) are explained below.
